Membership Agreement
This Membership Agreement (“Agreement”) describes the terms and conditions under which remithome Corporation (“remithome”) offers you the use of our services. The Agreement is a contract between you and remithome, and it applies to your use of the remithome service, which allows members to directly engage banks for remittance services, and any related products and services, available through www.remithome.com (collectively known as the “Service”).

This Agreement affects your rights. In order to become a member in the Service, you must read, agree to, and accept all of the terms contained in this Agreement, including the Privacy Policy and all terms. You signify your agreement and acceptance of this Agreement by checking the “I Agree” checkbox on the Membership Agreement page on the remithome website at time of registration and by accessing and using the Service after you have registered for a remithome membership account.

In this Agreement, “we”, “our”, and “us” refer to remithome, and “you” and “your” refer to you, the member of the Service. Each bank that will receive and execute transfer instructions from you is a “Processing Bank” or a “remithome Processing Bank“. “Bank Account” refers to the checking, savings, share draft, money market, or similar accounts that you link to your remithome membership account. “Card Accounts” refers to the Visa or MasterCard credit or debit Card Accounts that you choose to link to your remithome Membership Account. The Bank Accounts and Card Accounts are debited to supply the funds for the transfers and fees.

1. Description of Service

1.1 remithome has developed a proprietary system that enables you to initiate a remittance by providing a request to Processing Banks to move funds on your behalf. The remithome system assists you by automatically routing your remittance instruction to the most appropriate Processing Banks based on a variety of factors, including the quickest delivery schedule, the bank branch location most convenient to the recipient, a competitive foreign exchange rate, and a variety of other factors.

Based on your instructions, the Processing Banks transfer funds, from your Bank Account or Card Account to your recipients in one of the following ways:
  1. deposited directly into the account of your recipient at a foreign bank;
  2. sent to a bank to be held for pick up by your recipients;
  3. delivered to your recipients' addresses via courier; or
  4. other methods as described on the remithome website.
remithome does not at any time take possession and does not at any time control any funds being remitted.

remithome charges a fee for its service, which is billed and included in the debit to your Bank or Card Account. This fee is used to compensate remithome and the Processing Banks for facilitating the transfer and delivering the funds to the recipients.

1.2 You acknowledge that remithome keeps information in order to facilitate completing and executing any remittance instructions. remithome also retains a history of the remittance instructions.

1.3 When you initiate a transaction using the Service to send money to your recipients, you acknowledge and agree that you are the initiator of those remittance instructions and that remithome Processing Banks are acting on your instructions.

1.4 When you send money, you remain the owner of those funds until they are accepted by the recipient or his/her agent or credited to the recipient’s bank or other account.



2. Description of Membership

2.1 By enrolling in the Service, and accepting this Agreement, you will be establishing your remithome membership account (“Membership Account”).

2.2 Your Membership Account enables you to use the Service in order to instruct a Processing Bank to debit your Bank or Card Account and deliver funds to your specified recipients, according to the terms of this Agreement. The money you send will be drawn from the Bank or Card Accounts you select.



3. Membership Requirements

3.1 You may hold only one Membership Account with remithome at any given time.

3.2 Only individuals or businesses who can form legally binding contracts under applicable law may use the Service. Minors, those whom we deem to represent an unacceptable credit risk, and those whom we have previously suspended from the Service, may not participate.

3.3 You must accept the terms of this Agreement in order to participate. You can do so by checking the “I Agree” checkbox on the Membership Agreement page on the remithome website at time of registration. Once you have registered for a Membership Account, you will be notified whenever there are changes to this Agreement. By continuing to use the remithome Service after this notification has been sent to you, you will be deemed to have accepted the terms of this Agreement, as modified.

3.4 You must register for the remithome Service in order to participate. To register, you will need to provide some basic identification and contact information. You will also create a login identity by supplying your email address and a password to secure your account. Businesses will need to provide the name of the authorized contact person as well as their business name.

3.5 You will be considered a member (“Member”) of the remithome Service when you have successfully completed the registration process. However, you will need to activate your Membership Account before you can use the Service. If we are unable to verify your identity electronically or you are registering as a business, you will need to activate your account using remithome’s alternative process, which will require you to provide copies of documents and additional information to verify your identity.

3.6 After you have activated your Membership Account, there are two more steps to complete before you can use the Service. First, you will need to link at least one Bank Account or Card Account from which to send money through the remithome Service. See Section 4 (“Linking Bank Accounts and Card Accounts”) below, for more information on linking accounts. Second, you will need to provide the name and address of at least one recipient to whom you wish to send money. You may also, at your option, provide your recipient’s bank account information to facilitate direct bank account deposits and/or additional contact information so we can notify your recipients of funds availability.

3.7 We will attempt to verify the Bank Accounts or Card Accounts that you link to your remithome Membership Account, and any other information you provide to us. If we are unable to verify some or all of the information provided, we may decline your application or, we may, at our sole discretion, enroll you in our Verified Funds program. Under our Verified Funds program, you will be able to use a Bank Account for remittances, but remithome will wait until your bank authorizes the debit to your Bank Account before remithome processes the transfer to your recipient. We will notify you if you have been selected for this program. If we request additional information from you, and you do not provide it in a timely fashion, we may close your remithome Membership Account.



4. Linking Bank Accounts and Card Accounts

4.1 You may link the Bank Accounts and Card Accounts of your choice to your remithome Membership Account by following the instructions given on the website.

4.2 By linking a Bank Account, you authorize remithome Processing Banks to access the linked Bank Account according to your instructions and in the manner described in Section 1 (“Description of Service”) above.

4.3 When you link a Bank Account, we may ask you to send us additional information (such as a voided check or copy of your account statement) so that we may verify the account. You will be able to use the Bank Account to send money with the Service only after you provide, and we validate, the requested information.

4.4 All linked Bank Accounts and Card Accounts must be held at banks located only in the United States of America or its territories including Guam, Northern Mariana Islands, Puerto Rico, United States Virgin Islands and American Samoa.

4.5 When you link a Bank Account or Card Account, you warrant and represent that you are an owner of, and/or have authority to conduct transactions with, each such account, and you authorize remithome Processing Banks to debit the account in the amount of any remittance instructions that you initiate, plus our fees as set forth in Section 10 of this Agreement. If you are not the owner of the linked Bank Account or Card Account, we may request that the account owner(s) provide an authorization letter granting you authority to use the account.

4.6 If you link a Bank Account or Card Account with the Service, you acknowledge that the bank where you have your account or the bank that issued the Card Account to you shall determine if additional fees apply to any transaction you conduct with the Service, including fees associated with the credit card issuer’s classification of the transaction as a purchase, a cash advance, or other type of transaction. Any additional fees charged by your bank are solely your financial responsibility and not that of remithome.



5. Sending Money

5.1 You may only conduct Send Money transactions using a Bank Account or Card Account that you have successfully linked to your remithome Membership Account. All transactions are subject to the applicable timeframes, daily limits, transaction limits, delivery restrictions, and fees specified in Sections 7, 8, 9 and 10 below.

5.2 When you use your Membership Account to initiate a request to a remithome Processing Bank to send funds to your recipient, you are authorizing us to request the Processing Bank to access the linked Bank Account or Card Account you specify, according to your instructions. You are responsible for ensuring that there are sufficient funds available in the designated account in order to complete all transactions you authorize. If there are insufficient funds to complete the transactions you authorize, you must provide either an alternative account for the Processing Bank to debit or send a cashier’s check to remithome in the amount of the transfer, the appropriate transfer fee, plus a returned item fee described in section 10. Should you be unable to provide either item, remithome may cancel the transaction, suspend use of the account and pursue other appropriate actions, including possible legal action.

5.3 You may send money only to recipients located in the Philippines, or other areas as may be listed on the remithome website. We reserve the right to modify this list at any time without prior notice.

5.4 You may use a single Send Money transaction to transmit funds to one recipient or multiple recipients.

5.5 You may choose to send money from your Bank Account in foreign currency or in U.S. Dollars. Foreign currency can be sent directly to your recipients’ bank accounts by electronic transfer (“Direct Deposit”), to your recipients via courier delivery (“Courier”), to a designated branch of a foreign bank for recipient pick up (“Cash Pick-Up”), or by other methods as listed on the remithome website.

If you choose to send money from your Bank Account in U.S. dollars, it will be sent directly to your recipients’ bank accounts by electronic transfer (“Direct Deposit”).

5.6 When you choose to send money from your Card Account, you can only send money in foreign currency using Direct Deposit, Courier, Cash Pick-Up, or other methods as listed on the remithome website.

Other options may become available. Please check the remithome website for updates on new features.

5.7 When you send foreign currency to your recipients from a Card Account, the U.S. Dollars sent will be converted to foreign currency using an exchange rate that we set and display on our website at the time you confirm the transaction.

5.8 Each Send Money transaction sent from your Card Account is authorized immediately when you confirm the transaction. Confirmed Send Money transactions sent using Card Accounts cannot be canceled.

Card Accounts cannot be used to initiate Send Money transactions for a future delivery date.

5.9 The remithome processing day (“remithome Processing Day”) runs from 2:00 PM Pacific Time (5:00 PM Eastern Time) up to but excluding 2:00 PM Pacific Time the following day. Each Send Money transaction sent from your Bank Account and initiated with a transfer date of “Today” will occur at the close of the remithome Processing Day.

5.10 For Send Money transactions scheduled for “Today”, the exchange rate posted on our website at the close of the remithome Processing Day is the actual rate used to convert U.S. Dollars to the foreign currency.

5.11 For Send Money transactions (from your Bank Account) that you schedule to be sent at a future date, we will disclose to you the estimated amount in foreign currency that your recipient will receive using the exchange rate posted at the time that you schedule the future transaction. On the actual date of the transaction, we will use the exchange rate posted on our website at the close of the remithome Processing Day to convert U.S. Dollars to the foreign currency.

This actual exchange rate used for the transaction may be higher or lower than the estimated exchange rate disclosed to you when you scheduled the transaction due to fluctuations in market rates. Whenever a Send Money transaction occurs, we will send an email to you identifying the actual exchange rate used, as well as the amount of foreign currency sent to your recipient(s). By scheduling a Send Money transaction, you agree to accept the actual exchange rate that is current as of the date and time the Send Money transaction occurs.

5.12 The exchange rate applied to the Send Money transaction may not be the same rate that a remithome Processing Bank will use to convert U.S. Dollars to that currency. The difference between these exchange rates is the foreign exchange rate spread gain or loss that accrues to remithome.

5.13 If our Processing Banks make a good faith attempt at delivery but are unable to deliver the funds to your recipient within 90 days of the date of the Send Money transaction and such inability to deliver is due to reasons outside of their control (for example, if the recipient information such as name, address, phone number, and bank account information is incorrect, or if your recipient refuses delivery, is unavailable after multiple delivery attempts, or is unable to provide acceptable identification for cash pick-up or door-to-door receipt of cash funds, or if your recipient’s bank account is closed), we will cancel the undeliverable transaction and return the money to you by check using U.S. mail or by electronic funds transfer. The amount returned will be converted back from the foreign currency to U.S. Dollars using the exchange rate used in the original Send Money transaction. Any fees associated with the original transaction will not be refunded and we will assess an additional $15 service fee for canceling the transaction.

5.14 You may instruct us to notify your recipients that you have sent them money. Upon your instructions, we will send an email or a text message to the email or phone number you provide to us for your recipients at no additional expense to you. However, we do not guarantee that a recipient will actually receive the message nor that they have read it. We are also not responsible for any charges or fees that your recipient may incur for receiving these messages.

5.15 You may request to cancel a Send Money transaction (to be sent from your Bank Account) by using the www.remithome.com website, or by contacting our customer service representatives. We will try to honor any request to cancel a transaction as long as we receive the request before 2:00 PM Pacific Time (5:00 PM Eastern time) on the day the transaction is scheduled to occur, but will bear no responsibility if a cancellation request is not completed. Requests received at or after 2:00 PM Pacific Time cannot be honored, and your account will be charged.

5.16 Each Send Money transaction sent from your Card Account is authorized immediately when you confirm the transaction. Confirmed Send Money transactions sent using Card Accounts cannot be canceled.

5.17 remithome is not responsible for transfers to unintended recipients due to incorrect information provided by you. When conducting transactions, you are responsible for providing correct information about recipients, including but not limited to, legal names of recipients, recipient bank account numbers, account type, account currency, bank name, bank routing and sort codes, branch names or numbers, and recipient addresses and contact phone numbers.

5.18 You consent to have your name, email address, and the amount of the transfer disclosed to any recipient to whom you send money.

5.19 According to United States federal banking regulations, your bank may be required to limit the number of transactions originating from your savings or money market accounts. Transactions funded from your savings or money market accounts that are linked to your remithome Membership Account will be subject to these limitations. Check with your bank for more information.

5.20 You warrant that you are not using remithome’s services to perform any illegal act. remithome is legally obligated to report to law enforcement all information about any payment requests that appear to involve money laundering or are otherwise suspicious.



6. Recurring Instructions

6.1 You may schedule Send Money transactions to repeat periodically, on a weekly, monthly, yearly, or some other basis (“Recurring Instructions”). You may create or cancel Recurring Instructions using the website, at www.remithome.com.

6.2 Transfers pursuant to Recurring Instructions may only be sent using Bank Accounts. You may not schedule Recurring Instructions using a Card Account.

6.3 You may create a Recurring Instruction to transmit funds to one recipient or to multiple recipients.

6.4 When you choose to establish Recurring Instructions, you authorize the Processing Bank to execute multiple Send Money transactions according to the schedule you specify. We will continue to facilitate transfers pursuant to Recurring Instructions from your Membership Account as indicated, unless you cancel your Recurring Instruction, request that we cancel an individual transfer, or until the Recurring Instruction expires. Recurring Instructions expire on the date you specify, or when you choose to cancel them using the website, www.remithome.com. Note that transfers will not be processed on the End On date. To ensure that your instruction is handled properly, specify an End On date that is at least one day after your last desired transfer date. As with all Send Money transactions, you are responsible for ensuring that funds are available in the Bank Account from which you have scheduled the recurring transaction to be made.

6.5 If a Recurring Instruction is subject to foreign currency exchange rates, we will disclose the estimated exchange rate to you on the remithome website at the time you schedule the Recurring Instruction. The actual exchange rate used for each Send Money transaction in the Recurring Instruction series will be the exchange rate in effect as of the date and time the transaction occurs. This rate may be either higher or lower than the estimated exchange rate disclosed to you when you scheduled the Recurring Instruction, due to fluctuations in the market rates. Whenever a Send Money transaction occurs, we will send you an email identifying the actual exchange rate used, as well as the amount of foreign currency sent to your recipient(s). By scheduling a Recurring Instruction, you agree to accept the actual exchange rate in effect as of the date and time each Send Money transaction in the series occurs.

6.6 Each Send Money transaction in a Recurring Instruction series will count toward your Membership Account’s transaction limits, as specified in Section 8 below. Recurring Instructions can be created only if the total amount of the transactions processed for a single day does not exceed the limits set for your service.



7. Timeframe

7.1 Send Money transactions utilize local and international banking systems in order to transmit funds to your recipients. Funds must first be made available from your linked Bank Account or Card Account, and then delivered to your recipients. The table below estimates how many days it will take for funds to be delivered to your recipients. remithome defines a business day as Monday through Friday, except U.S. and Philippine bank holidays (“Business Day”).

The actual date the transferred funds will be available for pick-up or delivery to the recipient is subject to delays and prohibitions of local laws, weekends, bank holidays, and limitations of bank and clearing systems. Because these factors are beyond the control of remithome, the delivery timeframes shown are estimates and are not guaranteed.

7.2 Send Money transactions using your Bank Account occur at the end of remithome’s Processing Day on Business Days. Transactions occurring at or after 2:00 PM Pacific Time (5:00 PM Eastern Time) with a transfer date of “Today” will occur the next Business Day.

Send Money transactions using your Card Account are authorized immediately, including weekends and holidays.

7.3 For those in the Verified Funds program, sending money using a Bank Account is a two-step process: (1) On the Business Day the Send Money transaction occurs, remithome will send a notification to your bank requesting a debit to your account equal to the amount of the transaction plus remithome’s fee. We will wait until your bank verifies and authorizes the debit before sending transfers for delivery to your recipients. This usually takes 3 Business Days. (2) Once your bank has verified and authorized the debit, remithome will send the transfers for delivery, and your recipients will generally receive the money in the timeframes outlined in 7.1. The total delivery time will be the sum of the times in this two-step process.

Card Account transactions are not affected by the Verified Funds program waiting period because they use your Card Account, which provides instantaneous authorization.



8. Send Money Daily Limit

8.1 Send Money transactions are subject to a daily limit. All Send Money transactions sent from your Card Accounts or Bank Accounts, including transactions scheduled to occur at a future date or as part of a Recurring Instruction, are subject to this limit established for you by remithome. We reserve the right to change this daily limit at any time.

You may send multiple transactions using your Bank Accounts and Card Accounts for a given processing day as long as the total amount of the transactions processed for a single day does not exceed the daily limit set for your service. remithome fees are not included in calculating the daily limit.

8.2 Your daily limit is shown in U.S. Dollars on the Send Money page in your remithome account. To request a limit increase, please send an email to customerservice@remithome.com.



9. Send Money Transaction Limits

9.1 All Send Money transactions sent from your Bank Accounts or Card Accounts are subject to a minimum of $10 per recipient.

9.2 Send Money transactions sent from your Card Account are subject to a maximum transaction limit of $500 per transaction. You may send multiple transactions using your Card Account, as long as the total amount of your Card Account and Bank Account transactions does not exceed your daily limit for that day.

9.3 Send Money transactions sent from your Bank Account are subject to a maximum transaction limit equal to your daily limit. You may send multiple transactions using your Bank Account, as long as the total amount of your Card Account and Bank Account transactions does not exceed your daily limit for that day.



10. Fees

10.1 You are responsible for paying the fees associated with the Service, according to the table below. We reserve the right to change the fees at any time, with advance email notice to you. Any fee change would apply to any scheduled transaction that has not yet been sent.

The fees vary based on the number of recipients per transaction, whether the transaction is one time or recurring, whether your recipients will receive money in U.S. Dollars (“USD”) or a foreign currency, and whether the transaction uses your Bank Account or your Card Account. Fees shown are in U.S. Dollars.

10.2 If your bank refuses to honor a Send Money transaction from your linked Bank Account we will charge you a “returned item” fee of $25.

In the case where your bank refuses to honor a withdrawal from your account, you authorize remithome Processing Banks to debit any of your linked Bank or Card Accounts for the funds delivered to your recipient(s) per your instruction(s), for our transfer fees, and for this “returned item” fee. If the linked Bank or Card accounts cannot be successfully debited, we may request that you provide an alternate Bank or Card account or send us a cashier’s check in the amount of the transfer, transfer fees, and “returned item” fees. If you do not do this, remithome may cancel your transaction, suspend use of the account and pursue other appropriate actions, including possible legal action.

10.3 We do not charge your recipients a fee for receiving money. However, the actual amount of money received by your recipient may be reduced by charges, if any, imposed by the recipient’s bank. remithome is not responsible for any such charges. We are also not responsible if your recipient’s bank as a matter of their policy, places holds on the funds we deposit to your recipient’s account at that bank.

10.4 Your bank may charge fees for transactions using your Bank Account or Card Account. Your bank may charge a fee for using a debit card or a cash advance fee if you use a credit card. Check with your bank to see if they consider a money transfer to be a purchase (with no cash advance fee) or a cash advance (with a cash advance fee). remithome is not responsible for any such charges.



11. Account Access and Protection

11.1 Your remithome Membership Account is intended exclusively for your own use. No one but you may use your account, and you may not use anyone else’s account. It is your responsibility to safeguard your account information, including your email address, password and member identification information. Do not disclose your password to anyone else and do not write it down anywhere where someone else might see it. Your password is a critical means of protection. If you think that your password has been compromised, you should immediately change your password on the website, or call us to suspend your account.

11.2 If you believe that someone has accessed your Membership Account without your permission, you should access your Membership Account and change your password immediately and also contact us to cancel any unauthorized transactions that are still in process or have been scheduled. 11.3 Whenever your member identification and password are entered into the login area of our website, remithome must assume that it is you, the Member, who is using the account. You are responsible for all transactions that take place using your Membership Account.



12. Use of Membership Account for business purposes

12.1 If you are using your Membership Account for business purposes, you understand that remithome uses a “security procedure” to verify that transaction instructions are in fact authorized by you. This security procedure consists of verification of your login identity and password and sending confirming email notices to your email address on file. remithome will send such email notices when a Send Money transaction is scheduled and before any future scheduled transactions. You agree that, given the size, type, and frequency of your transactions with remithome, this security procedure is a commercially reasonable one. Accordingly, you are responsible for all transactions that take place using your Membership Account provided the correct login identity and password combination have been properly entered.



13. Problems or Errors

13.1 remithome will investigate any problems or errors you report to us. If you suspect that there has been an error involving your Membership Account, contact us immediately. In order to assist you, we will need to know your name and login identity (email address), as well as the time and date of the transaction, the dollar amount of any suspected error, and why you believe an error has occurred.

13.2 remithome sends email notices to the email address that you registered with us for each transaction that you initiate using your Membership Account. Please keep a record of these email transaction notices and compare these transaction notices with your bank or credit card statement(s) to determine if there were any problems or errors. In addition, your Membership Account with remithome allows you to access and review your last 12 months of transaction history through the remithome website at any time.

13.3 With respect to inquiries about problems or errors with your account, we may ask you to send us information regarding your account in writing, in which case we must receive the requested information within ten (10) Business Days.

13.4 We will try to determine whether an error occurred within ten Business Days after we hear from you, and we will correct any error promptly and provide you notice by email. If we need more time, however, we may take up to 45 calendar days to investigate your complaint or question.

13.5 If we determine that there was no error, we will email you an explanation within three Business Days of completing our investigation. You may request copies of the documents we used in conducting our investigation.

13.6 Although we are responsible for resolving any errors in transactions involving your Membership Account, whenever you believe an error has occurred in a transaction involving any of your linked Bank Accounts or Card Accounts, you should also immediately contact the bank that issued the account to you, in order to preserve any dispute rights you may have with that bank.



14. Privacy and Security

14.1 We protect your privacy and use your information according to our Privacy Policy, which is expressly incorporated into the terms of this Agreement. The current Privacy Policy is located online,
at http://www.remithome.com/privacy-commitment.html.

14.2 All pages related to the Service begin with https://www.remithome.com, and you should not conduct Service-related business with any page that does not begin in that way.



15. Account Termination

15.1 You may terminate your Membership Account at any time, but you are responsible for all transaction fees and charges you incur before such termination. If you choose to terminate your Membership Account, any unprocessed scheduled or recurring transactions will be canceled. Transactions that are in progress cannot be canceled and will be processed with the appropriate fees charged. We recommend that you cancel any scheduled transfers and recurring instructions prior to notifying us that you are discontinuing the Service.

15.2 We have the right to terminate your Membership Account, or place restrictions upon your use of the Service (such as rejecting, reversing, or canceling your account transactions) for any reason, including but not limited to our inability to verify any information you provide; your failure to provide us with any information we request; your submission of information about your Bank Accounts or Card Accounts or otherwise that we believe to be false or inaccurate; your using of a Membership Account that does not belong to you; your revealing your remithome password to another party; your using the Service for any unlawful activity or purpose; any behavior by you that we believe is suspicious; or your using the Service in violation of any of the terms of this Agreement.



16. Legal Compliance

16.1 You agree to defend us and hold us harmless from all actions, liabilities, and costs, (including reasonable attorney’s fees) associated with our compliance with any legal process, including any writ of attachment, adverse claim, garnishment, levy, tax, execution, restraining order, warrant, subpoena or other legal process, which we believe (correctly or not) to be valid related to any transaction of which you are a part. We may seek reimbursement for record research, photocopying and any handling costs from the party serving the process; however, you agree that we may charge your Bank Account or Card Account for these activities if we do not otherwise receive full reimbursement.



17. Notices and Contact Information

17.1 You agree that, to the fullest extent allowed by law, this Agreement, as well as any other notices, agreements or other communications to you regarding your use of the Service or your Membership Account (“Communications”), may be sent by us to you electronically. However, remithome reserves the right to send Communications to you in paper form by U.S. Mail, and you agree to accept them.

17.2 You acknowledge that this Agreement constitutes a “writing” signed by you under any applicable law or regulation. You also agree that all Communications, regardless of whether they are delivered in electronic or paper form, will be considered to be in “writing”.

17.3 Any notices intended for remithome shall be sent by postal mail to the address shown below, unless explicitly stated otherwise.

17.4 All notices sent electronically are deemed given 24 hours after the email is sent. All notices sent by postal mail are deemed given after 3 calendar days from the date of the mailing.

18. Disputes Resolved by Arbitration and Terms of Arbitration

remithome seeks to settle all disputes equitably, quickly, and at low cost. While the provisions of this section give both you and us rights to certain legal proceedings, we encourage you to contact us directly to seek a resolution to any dispute before attempting to initiate any legal or other proceeding. We will consider any reasonable suggestion to resolve disputes through mediation or other alternative dispute resolution methods.

READ THIS SECTION CAREFULLY. IT STIPULATES THAT EITHER YOU OR WE HAVE THE RIGHT TO REQUIRE THE RESOLUTION OF ANY DISPUTE OR CONTROVERSY BY BINDING ARBITRATION, WHICH REPLACES THE RIGHT TO GO TO COURT, INCLUDING THE RIGHT TO A JURY AND THE RIGHT TO PARTICIPATE IN SIMILAR PROCEEDINGS. ARBITRATION RELIES ON A NEUTRAL ARBITRATOR, RATHER THAN A JUDGE OR JURY, TO RESOLVE DISPUTES. ARBITRATION OPERATES UNDER PROCEDURES THAT ARE MORE LIMITED THAN THE RULES APPLICABLE IN COURT, AND THE DECISION OF AN ARBITRATOR IS FINAL AND BINDING ON BOTH PARTIES.

18.1 Upon your or our election, any dispute that may arise between us, including any dispute related to the Service, your Membership Account, enrollment or this Agreement, will be resolved by binding arbitration in accordance with California Code of Civil Procedure §§1280 et seq., with the exception of those disputes specifically excluded below, and unless we may both agree otherwise in writing. If you would like a copy of the relevant code sections, let us know and we will send you a copy.

18.2 Disputes specifically excluded from arbitration include any dispute filed individually in a small claims court, provided that the dispute pertains only to an individual claim for relief, and only as long as it remains in such court. Additionally, disputes related to your infringement, or threatened infringement, of our intellectual property rights are not subject to arbitration.

18.3 We maintain our right to self-help remedies, such as the right of set-off, or to interplead funds in the event of a dispute, or to obtain provisional remedies (injunctive relief, attachment, garnishment, etc.) by a court having appropriate jurisdiction. Nothing herein shall be deemed to limit or constrain our resort to such actions.

18.4 The party initiating the arbitration must notify the other party in writing, at the contact information shown in Section 17 (“Notices and Contact Information”), above. Arbitration proceedings shall be conducted in San Francisco, CA, or another city as we both may agree to in writing.

18.5 The arbitration provisions included in this Agreement shall survive the termination of or changes to this Agreement, the bankruptcy of any party, and the transfer or assignment of your remithome Membership Account.



19. TELL A FRIEND Program

You are automatically a participant in remithome’s Tell A Friend Referral Rewards Program (“Tell A Friend”) once you have a remithome Membership Account. You acknowledge that you have read, understood, and agree to be bound by these Rules and Guidelines.

19.1 Eligibility. The Tell A Friend Referral Rewards Program is open only to users of remithome and under the following rules and guidelines.

19.2 Persons Who May Be Referred. You may only use remithome’s Tell A Friend email to refer remithome to individuals with whom you have a pre-existing personal or business relationship and whom you believe would like to receive the remithome Tell A Friend email. You may not obtain names for referrals from a) group email addresses or b) email mailing lists unless you have a pre-existing personal or business relationship with the members of the group. Members may not submit themselves for referral credits. To be eligible for referral, the individual must not have previously registered with remithome as of the time of referral.

19.3. No Spamming. We strictly forbid the sending of unsolicited email to numerous recipients (“spamming”). You may only send a Tell A Friend email to people that you personally know or with whom you have a pre-existing personal or business relationship. Any remithome member who spams Internet users for referral rewards will have his or her Membership Account terminated.

19.4 Number of Referral Credits. At the current time, there are no restrictions on the number of referral credits you may earn or the number of users you can refer.

19.5 Earning Referral Credits. At the time you register as a remithome member, you are assigned a number (“Referral Code”) that you can use to earn referral credits. When someone you refer registers as a remithome member using your Referral Code and completes at least one Send Money transaction, you will receive 5 credits (or some other amount that we determine at our sole discretion from time to time, as published on our website) in your remithome account. Each credit is currently valued at $1, so each referral is currently worth $5. We reserve the right to change the value of each credit at any time; the value will be published on our website. A Referral Code can only be entered at the time of registration and no credits will be earned if the person you refer fails to enter your correct Referral Code. Referral credits are awarded only once for each new registrant.

19.6 Redeeming Referral Credits. Referral credits can be redeemed for three types of rewards:
  • Fee Rewards (to pay for future remithome transaction fees)
  • Gift Cards
  • Phone Cards (for long-distance calls to the Philippines)
To request a gift card or a phone card, you must have at least 25 Available Credits, as displayed on the My Rewards page of your remithome account. Once referral credits are redeemed for a reward, they cannot be cancelled or reallocated toward a different reward. Only the registered member may redeem referral credits by logging into his or her remithome account and clicking on the My Rewards button.

19.7 Remedies for Noncompliance. If remithome determines in its sole discretion that you have not complied with these Rules and Guidelines, it may, in addition to any other rights and remedies it may have against you, immediately and without notice to you, withdraw all benefits to you and your referrals under this Tell A Friend Referral Rewards Program (including, without limitation, by canceling or declining to credit any and all referral credits issued or to be issued to you and to any of your referrals in connection with this program).

19.8 Your Consent to Use Your Data in Emails. You grant remithome your consent for it to use your name and email address for the purposes of sending email to your referrals for this rewards program. You agree not to use any false email addresses or names for this Tell A Friend Referral Rewards Program.

19.9 Your Representations and Warranties to Us. You represent and warrant to remithome that you have an existing business or personal relationship with each friend or family member you refer and that it is your genuine opinion that each referral would wish to receive the remithome Tell A Friend email from you through remithome. By providing us with email addresses of your referrals, for transaction purposes, you are affirmatively requesting and authorizing remithome to send them an email, as outlined here, on your behalf.

19.10 Termination. remithome reserves the right to terminate the Tell A Friend Referral Rewards Program at its discretion. Notice of the program termination will be sent to participants via email.

19.11 Variation of the Rules and Guidelines. These Rules and Guidelines may be amended or modified by remithome at its sole discretion at any time and these amendments and modifications will apply to you when you participate in remithome’s Tell A Friend Referral Rewards Program. Any such amendments will be posted to the Membership Agreement page on the remithome website.

19.12 Currency. All amounts stated in these Rules and Guidelines are in U.S. Dollars.

20. General

20.1 Except as otherwise noted above, this Agreement shall be governed by the laws of the state of California (exclusive of its laws regarding the conflict of laws) and applicable Federal laws and regulations.

20.2 If you make a purchase and pay for that purchase using the remithome service, remithome makes no guarantees regarding your purchases. You agree that we are not responsible for ensuring the safety, quality or delivery of anything purchased using the Service.

20.3 Disputes that may arise between you and a recipient are not the responsibility of remithome. You agree to conduct transactions with other parties at your own risk.

20.4 You may not use the remithome Service for the purpose of obtaining a cash advance to yourself from a credit card.

20.5 We may amend, add to, or delete any part of this Agreement at any time, including all provisions pertaining to fees, the rights and responsibilities you or we may have under this Agreement, and enforcement measures. Unless otherwise required by law, and except as specifically stated herein, we may amend this Agreement without providing prior notice to you. We shall notify you by email if the Agreement has been changed. Copies of the current Agreement will be available through www.remithome.com or by contacting customer service.

20.6 remithome reserves the right to assign the rights and obligations given to us by this Agreement to a third party. You may not assign your Membership Account to a third party.

20.7 If remithome fails to complete a transfer in accordance with this Membership Agreement, remithome’s sole liability will be to issue to you a full refund of the amount of your transfer, including any fees paid to us. In no event will remithome be liable for any consequential, incidental, exemplary, punitive or special damages arising out of any failure by remithome to execute a transaction according to your instructions, even if we have been advised of the possibility of such damages.

20.8 In order to ensure the quality of our service, we may monitor any telephone calls you make to us.

20.9 remithome®, the remithome logo, remithome, remithome.com, and all other names, logos, page titles, buttons, icons and all related products and services are registered trademarks, and/or trade dress of remithome, and may not be used, in whole or in part, nor copied, modified or imitated, without the prior written consent of remithome.

20.10 Unless otherwise specified, all dollar amounts shown in this Agreement are in U.S. Dollars.

20.11 If any provision of this Agreement shall be invalid, illegal or unenforceable in any respect, such provision shall be deemed ineffective to the extent of such invalidity, illegality or unenforceability without invalidating or impairing the remainder of such provision or the remaining provisions of this Agreement.
